2. Acceptance and scope

By using this website, you agree to these terms. If you do not agree, do not use the website. Separate signed terms, statements of work, data processing terms, service levels and commercial schedules govern any customer deployment and prevail over these website terms for that engagement.

3. Product and business information

Website content is general information and an invitation to discuss possible services. It is not financial, accounting, legal, tax, medical, agronomic or investment advice and is not a substitute for professional judgement.

Features may depend on agreed configuration, source quality, third-party access, validation, security review and customer acceptance. Forecasts, scenarios, risk indicators and recommendations are decision-support outputs, not guarantees of future performance, savings, fraud prevention, crop outcomes or compliance.

Zardin's public content does not replace qualified agronomists, extension officers, official crop guidance, pesticide labels or emergency instructions. KESTREL is a future product in development. It is not available for clinical use, is not a medical device and does not provide diagnosis, treatment or medical advice.

4. Intellectual property

The website, product names, text, design, software representations, graphics, original diagrams and other materials are owned by or licensed to FARI Technologies Ltd and are protected by applicable intellectual property law.

You may view and print reasonable extracts for internal evaluation. You may not reproduce, publish, sell, modify, reverse engineer or create misleading derivative materials without written permission. Third-party names and marks belong to their respective owners; reference does not imply endorsement.

5. Acceptable use

You must not use the website unlawfully or in a way that damages, disables or interferes with it. Prohibited activity includes unauthorised access attempts, credential attacks, malware, denial-of-service activity, automated extraction that places unreasonable load on the service, removal of legal notices, impersonation and submission of unlawful or confidential third-party data without authority.

Good-faith security research must follow our responsible disclosure policy.

6. Enquiries, trials and contracting

An email, meeting request, product briefing or discussion does not by itself create a contract, partnership, agency, fiduciary relationship, exclusivity obligation or binding commitment. A binding commercial engagement exists only when a written agreement is signed by authorised representatives.

FARI's published one-month trial carries no FARI platform subscription fee and begins only after both parties agree the evaluation scope, authorised data, access controls, responsibilities and success measures in writing. External licences, paid APIs, messaging, specialist providers and other third-party charges are excluded unless the written trial terms expressly state otherwise. Continued use after the trial requires a separate signed commercial agreement.

Custom development, system integrations and included services agreed during discovery are governed exclusively by the signed package and scope of work. FARI does not charge an additional service fee for work expressly included in that scope. Work outside the agreed scope and any third-party provider charges remain subject to written agreement and change control.

8. Availability and changes

We aim to keep the website accurate and available, but may change, suspend or withdraw content without notice. We do not promise uninterrupted or error-free access. We may update these terms and will publish the effective date of the revised version.

9. Liability

To the fullest extent permitted by applicable law, FARI Technologies Ltd is not liable for indirect, incidental, special or consequential loss arising solely from reliance on general website content or inability to access the website.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or other non-excludable statutory responsibility. Any liability relating to a purchased product or service is governed by the signed customer agreement.

10. Governing law and contact

These terms are governed by the laws of Mauritius. Subject to any mandatory law, the courts of Mauritius have jurisdiction over disputes concerning these website terms.
